Top Compensation Lawyer Forewarns Impact of Proposed Decrease in Benefits

Talk of an imminent restructure to the Workers Compensation System in NSW has been a popular and controversial news topic in recent times. Leading compensation lawyers, Sydney based Taylor and Scott Lawyers, are strongly recommending any workers with an injury to seek urgent legal assistance as the planned changes feature a dramatic reduction in benefits in order to reduce employers premiums and reduce WorkCovers current deficit.

Whilst the Premier is yet to announce what the reforms will entail it is believed to be the introduction of a system similar to that seen in Victoria, explains expert compensation lawyer & Managing Partner, Gervase Liddy.

These changes are going to have a major impact on all workers but especially young and middle aged workers who suffer an injury at work that prevents them from returning to their pre-injury occupation.

If the government does in fact follow its Victorian counterparts, the potential strain on family funds will arise due to the length of time injured workers will have their medical bills reimbursed.

As it currently stands in Victoria, injured workers only have their medical bills paid for 12 months, except in the case of more serious injuries. After this period the injured worker is forced to rely on their own private health insurance and the public health system.

In addition to this, injured workers only receive compensation for loss of wages for a closed period of a few years and after that are left to rely on social security and/or their own financial resources.

This is in stark comparison to NSW, where the current legislation permits injured workers medical bills to be covered for life providing such treatment remains reasonable and necessary.

In addition, weekly compensation benefits are paid to workers who continue to suffer a work related incapacity and wage loss until 12 months after they have reached retirement age.

To add insult to injury, there is also talk that the Premier intends to dismantle the work injury damages legislation. If this is passed, workers with serious injuries caused by employer negligence would not be entitled to sue their employer for negligence, states Mr Liddy.

An example of this would be a worker paralysed as a result of a workplace accident caused by employer negligence. They would only be entitled to weekly compensation benefits for a maximum period of 4 years despite the fact that they may never be able to return to work. As a compensation lawyer, I just dont think this would be fair.

my ex beat my son up he basically got away with it he got 1yr. probation and 60 hrs. community srevice. and my son is living with me because of it. we are still in court over this he said the only way he will let me have full custody is if i don’t go for child support. i look at it this way he is still his son he should take full responsibility for his actoin’s and even though he is pleading guilty he should still help support him also. so my question is how do i get him to pay and not get away with any more then what he already has? or do i wait till he get’s married and then try and get child support? don’t they consider a married couple’s income combined as one? i am not sure how to do this but i don’t want him to not have to help support my child.

That issue should be brought up in court….Maybe they could garnish a percentage of his WC….. You should have a lawyer they would know how to go about that!

Need advice on finding a laywer/law firm specializing in estate litigation in multiple states…?

Question by Audrey: Need advice on finding a laywer/law firm specializing in estate litigation in multiple states…?
My grandmother passed away without a will a couple months ago and I need to find a lawyer to settle her estate. My father was her only child and both him and her husband are deceased. I was informed that I am her next of kin (correctly? incorrectly?) in accordance with PA law. She had a brother who I am not on speaking terms with.. I’m not 100% sure if he is on the deed but tend to think he is not.

Problem is, I live in Richmond, VA and the house is in Philly, PA. I have received a tentative offer of $ 100,000 for it in as-is condition but can’t sell without being made administator of her estate. I have a younger brother but but I’m fairly certain I could get him to sign a renunciation.

Financially, i’m not loaded but not entirely broke. I also have several $ K insurance money tied up in red tape right now. Ideally I could find a lawyer with reasonable initial fees who would be willing to work for a percent of the profit made from the house sale. What is the best way to find one?
To add a few details: If I have to find a Philadelphia lawyer, how do I do this from Virginia? I can’t take time off from work to meet with anyone out of state as i’ve just started a job and won’t have any days off until July-August. My car is…Not exactly fit for out of state ventures at the moment, lol. Is there really no way to work through a multi-state firm? What about appointing someone in Philly as my representative – is this possible? (my mother lives up there)

You need to find a Philly lawyer. Bar privileges do not extend to other states – the atty has to be licensed in PA. Call the PA Bar Association to locate referrals in estate law specialists.

Question by : How much should i ask for when i go to court?
I was at work when a friend came in to test drive a car. He was test driving a srt10 viper truck. During the test drive he lost control of the truck and totaled it. I don’t remember the accident. He told the officers that i told him to slow down that there was a turn to the right and then he hit the curb and then he lost it. The truck’s right side tires sheared off and the truck went airborne settling down 10 feet from the treeline and 30 feet from the initial impact. I went to the hospital for my shoulder and right hand and arm and went to all the workman’s comp doctors and orthopedic surgeons. I had surgery on my left hand were the tendons had tore off my fingers. I was out of work for a month and a half. I have hired an attorney but i don’t want to be shafted by anyone. How much is a respectable amount that i should get.

After stonewalling several attempts at transparency, a lawsuit and a some much-deserved public shaming may finally be spurring the Department of Labor to comply with Freedom of Information Act requests. Last week, I noted that the National Right to Work Legal Defense Foundation had filed a lawsuit with the U.S. District Court because the Department of Labor had been totally unresponsive to their FOIA attempts to get information about any legal and financial relationships, as well as communications Obama administration labor appointees might have had with union groups.
